Privacy policy

At ClaudIA Tech we process the information you provide in order to answer your enquiries. This policy explains how we do it, in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).

It covers two different situations, and they are worth keeping apart: the data you give us on this website, where we are the controller (sections 1 to 7), and the data that goes through our products, where the controller is the business using them and we act as processor (sections 8 and 9).

2. Data we collect

Through the contact form we collect the data you provide: name, email address, subject and the content of your message. We do not collect special categories of data and we ask you not to include them in your messages.

3. Purpose

We use your data solely to handle and reply to the enquiry you send us. We do not use it to send you unsolicited commercial communications, nor do we build profiles with it.

4. Legal basis

The basis legitimising the processing is your consent, which you give by sending us the contact form. You may withdraw it at any time without affecting the lawfulness of processing prior to its withdrawal.

5. Retention

We will keep your data for as long as necessary to handle your enquiry and, afterwards, for the periods required by law. Once it is no longer necessary, it will be deleted.

6. Recipients

We do not share your data with third parties except where legally required. For sending messages and hosting the site we use service providers acting as processors with appropriate safeguards. Data is hosted in the European Union.

7. Your rights

As the data subject, you have the right to:

• Access your personal data.
• Request its rectification where it is inaccurate.
• Request its erasure.
• Object to its processing.
• Request the restriction of its processing.
• Request the portability of your data.

You can exercise these rights by writing to hola@claudiatech.es. If you believe we have not handled your request properly, you have the right to lodge a complaint with the Spanish Data Protection Agency (aepd.es).

8. Data we receive through messaging platforms

Everything above refers to this website. What follows refers to our products, soyclaudia.app and soyclaudiadental.com, where the processing works differently.

Each business connects its own messaging channels to ClaudIA, including its WhatsApp Business account. From that moment on, ClaudIA handles the messages people send to that business.

Through those channels we receive the phone number and profile name of whoever writes, the content of the messages and the files attached (photos and voice notes). This data is used solely to handle the enquiry and manage the appointment: identifying the person in the business's records, checking availability in the schedule and booking, changing or cancelling the appointment, as well as sending reminders for confirmed appointments.

In this processing the controller is the business and CLAUDIA TECH, S.L. acts as processor, under the contract signed with it. If you are a client of a business that uses ClaudIA and you want to exercise your rights, contact that business; we assist them in doing so.

We do not sell or transfer this data to third parties, we do not use it for advertising or to build commercial profiles, and we do not cross it between different businesses: each business only has access to the data of its own clients.

To provide the service we rely on the messaging providers that connect those channels, as well as Meta Platforms Ireland Ltd. in the case of WhatsApp, which act as processors or sub-processors with the safeguards required by the GDPR.

Data is hosted in the European Union. Some artificial intelligence, voice or messaging providers may process it outside the European Economic Area under the safeguards provided by the GDPR; the detail, provider by provider, is in each product's own privacy policy (soyclaudia.app and soyclaudiadental.com), which is the one that applies to this processing.

9. How to delete your data

If you are a client of a business that uses ClaudIA, your data is the responsibility of that business. You can request its deletion in two ways: by writing directly to the business, or by sending us an email at hola@claudiatech.es stating the business and the phone number you wrote from. We will pass the request on to the business and assist them in handling it within the legal period of one month.

If you are a business client, you can request the deletion of your account and all associated data by writing to hola@claudiatech.es from the address you signed up with. Deletion is completed within a maximum of 30 days, except for data we are required to keep by law (invoicing, for example).

Regardless of any request, the files attached in conversations (photos and voice notes) are automatically deleted from our systems after 90 days. That deletion affects the copy hosted in our service; the original message remains in the business's messaging account, which is outside our control.
